Terms and Conditions
These Terms govern your access to and use of the Profusions Health & Wellness website, patient portal, telehealth visits, and related services. Please read them carefully — by using the platform, you agree to be bound by everything below.
Acceptance of Terms
By accessing the Profusions Health & Wellness website (myprofusions.com), our patient enrollment portal (enroll.myprofusions.com), our patient portal, or any related application, service, or communication channel (collectively, the “Applications”), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy and HIPAA Notice of Privacy Practices.
If you are entering into these Terms on behalf of another person or entity, you represent that you have the authority to do so. If you do not agree to any part of these Terms, you may not use the Applications.
Eligibility & Accounts
To use the Applications and request services from Profusions, you must be at least 18 years of age, a legal resident of the United States, and physically located in a state where the requested service is offered and where our providers are licensed at the time of your visit.
When you create an account, complete an intake form, or schedule a visit, you agree to:
- Provide accurate, current, and complete information about yourself and your medical history.
- Keep your account credentials confidential and not share them with anyone.
- Notify us promptly of any unauthorized use of your account or any other security breach.
- Accept responsibility for all activity that occurs under your account.
We may suspend, restrict, or terminate any account that we reasonably believe has provided false information, violated these Terms, or been used to attempt to misuse the Applications.
Healthcare Information & Educational Content
Content on the Applications — including blog posts, treatment overviews, pricing pages, FAQs, calculators, and informational articles — is provided for general educational purposes only. It is not medical advice, diagnosis, or treatment, and it does not establish a patient–provider relationship by itself.
You should never disregard, avoid, or delay seeking professional medical advice because of something you read on the Applications. Always consult a licensed healthcare provider with questions about a medical condition or treatment.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. The Applications and our telehealth visits are not designed for, and should not be used for, emergency or life-threatening conditions.
Telehealth Services & Provider Relationship
Profusions provides a technology platform that connects patients with independent, US-licensed healthcare providers (“Providers”) who deliver telehealth consultations and, where clinically appropriate, write prescriptions. Profusions itself does not practice medicine and does not employ the Providers in their clinical capacity.
By initiating a visit, you understand and agree that:
- A patient–provider relationship is formed only when a Provider accepts and reviews your intake.
- You consent to receive care via telehealth, including asynchronous (messaging-based) visits and, where required, synchronous video calls.
- You have been informed of the benefits, risks, and limitations of telehealth care, including that certain conditions cannot be safely diagnosed or treated remotely.
- You will provide accurate and complete information so the Provider can make safe clinical decisions.
No Guarantee of Treatment or Prescription
Submitting an intake, scheduling a visit, or paying a visit fee does not guarantee that a Provider will issue any specific diagnosis, treatment plan, prescription, or refill. Providers exercise independent clinical judgment and may decline to prescribe, may recommend in-person care, may request additional information or lab work, or may refer you to a specialist or emergency services.
If a Provider determines that the requested care is not clinically appropriate for you or cannot be safely delivered via telehealth, we will let you know and refund any amounts paid for that visit in accordance with our Payment, Pricing & Refunds policy.
Compounded & Specialty Medications
Some treatments offered through the Applications — including, without limitation, compounded semaglutide, tirzepatide, sermorelin, PT-141, NAD+, glutathione, and related preparations — are compounded medications. Compounded medications are prepared by a licensed compounding pharmacy and are not FDA-approved, although their active ingredients may be FDA-approved in other formulations.
You acknowledge that:
- Compounded preparations are prescribed only when a Provider determines, based on your individual clinical needs, that a compounded formulation is appropriate.
- Availability of any compounded medication is subject to change based on regulatory action, drug shortage lists, and the discretion of the dispensing pharmacy.
- Reported safety, efficacy, and side-effect profiles for compounded versions may differ from FDA-approved brand-name products.
- You should follow all dosing instructions, storage requirements, and follow-up guidance provided by your Provider and the compounding pharmacy.
Payment, Pricing & Refunds
Visit fees, membership fees, and medication prices displayed on the Applications are billed in US dollars and are payable at the time of checkout unless otherwise stated. Profusions does not bill health insurance directly. Some patients may submit receipts to their HSA, FSA, or insurance for possible reimbursement, but coverage and reimbursement are not guaranteed and are the patient’s responsibility.
Refund Policy
- Visit fees are refundable if a Provider determines, after reviewing your intake, that the requested care is not appropriate for telehealth or cannot be safely delivered.
- Prescription medications that have been dispensed and shipped are generally non-refundable, consistent with federal and state pharmacy regulations that prohibit the resale or re-dispensing of returned medication.
- Subscription plans may be cancelled at any time before the next billing cycle; fees already paid for the current cycle are not pro-rated.
- Disputed charges should be brought to our attention at admin@myprofusions.com before initiating a chargeback so we have an opportunity to resolve them directly.
We reserve the right to correct pricing errors, update prices, and adjust availability at any time. Pricing in effect at the time of your purchase governs that purchase.
Privacy, HIPAA & Protected Health Information
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, and our handling of Protected Health Information (“PHI”) is governed by our HIPAA Notice of Privacy Practices — both of which are incorporated into these Terms by reference.
By using the Applications, you acknowledge that:
- Information you submit through intake forms, messaging, and consultations may include PHI and is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state laws.
- We may share PHI with our Providers, contracted pharmacies, lab partners, and HIPAA-compliant technology vendors strictly for the purpose of delivering your care.
- We will not sell your PHI. We will not use your PHI for marketing without your explicit, separate authorization where required by law.
Cookies, Tracking & Analytics
The Applications use cookies, pixels, local storage, and similar technologies (collectively, “Tracking Technologies”) to operate the site, remember preferences, measure traffic, and improve our services. Some of these technologies are provided by third parties such as Google Analytics, Meta, and advertising or marketing platforms.
By using the Applications, you consent to the use of Tracking Technologies as described in our Privacy Policy. You can typically control or disable cookies through your browser settings, but doing so may affect the functionality of the Applications. We do not knowingly transmit PHI to advertising or analytics networks.
AI Chat & Live Chat
The Applications may include an AI-powered chatbot, a human-staffed live chat, or both. Any responses generated by these chat tools are general in nature, are not medical advice, and do not constitute a patient–provider relationship. Do not rely on a chat response in place of a consultation with a licensed Provider.
Chat conversations may be logged, reviewed, and stored to improve service quality, train AI models, and meet legal recordkeeping requirements. Please do not share sensitive PHI in a chat session unless and until you have been transferred to a secure, HIPAA-compliant channel by a member of our team.
SMS & Text Messaging Terms
If you opt in to text messaging from Profusions, you agree to receive transactional, appointment-related, and promotional text messages from us at the mobile number you provide. Messages may include visit reminders, prescription updates, refill alerts, special offers, and care follow-ups.
- Message and data rates may apply. Frequency varies.
- You must be 18 years of age and the authorized user of the mobile number you provide.
- Reply STOP at any time to unsubscribe from promotional messages. Reply HELP for assistance.
- Mobile carriers are not liable for delayed or undelivered messages.
- Consent to receive marketing texts is not a condition of purchase.

Email Communications
By providing your email address, you consent to receive transactional and service-related emails (visit confirmations, prescription notices, billing receipts, account notices, and security alerts) at that address. You may also receive marketing emails, which you can unsubscribe from at any time using the link in the footer of those messages.
We will continue to send transactional and required service emails even after you unsubscribe from marketing communications, because those messages are necessary to deliver the care and services you have requested.
Acceptable Use
You agree not to use the Applications to:
- Violate any applicable law, regulation, or third-party right.
- Misrepresent your identity, age, location, or medical history.
- Obtain a prescription for someone other than yourself, or attempt to divert, sell, share, or misuse any medication prescribed to you.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Applications, our servers, or any related systems.
- Copy, scrape, reverse-engineer, decompile, or create derivative works from any portion of the Applications, except as expressly permitted by applicable law.
- Upload or transmit viruses, malware, or any code intended to damage or impair the Applications.
- Harass, threaten, or impersonate any Provider, staff member, or other user.
Violation of these rules may result in immediate suspension or termination of your account and may be reported to law enforcement where appropriate.
Intellectual Property
All content on the Applications — including the Profusions name, logo, branding, text, graphics, photographs, video, software, page layouts, and the selection and arrangement of all of the above — is owned by AZ Profusions LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Applications strictly for your personal, non-commercial use of our services. All rights not expressly granted are reserved. You may not use any Profusions trademark, trade dress, or branded asset without our prior written consent.
User Content & Submissions
If you submit reviews, testimonials, photos, suggestions, or other materials to the Applications (other than PHI submitted as part of clinical care, which is governed by our HIPAA Notice), you grant Profusions a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, and display that content in connection with our business, including for marketing purposes.
You represent that any content you submit is yours to share, does not violate anyone else’s rights, and is accurate and not misleading. We may remove or refuse to publish any user content for any reason, at our sole discretion.
Third-Party Links & Services
The Applications may contain links to third-party websites, services, or resources that are not owned or controlled by Profusions. We provide those links for convenience only. We do not endorse and are not responsible for the content, privacy practices, or business practices of any third party, and your interactions with those parties are governed by their own terms and policies.
Disclaimer of Warranties
To the fullest extent permitted by law, the Applications and all related content and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise — including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
We do not warrant that the Applications will be error-free, secure, or continuously available, that any defects will be corrected, or that the Applications or the servers that make them available are free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, in no event will Profusions, its affiliates, Providers (acting in their non-clinical capacity), employees, agents, vendors, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation lost profits, lost data, loss of goodwill, business interruption, or substitute services — arising out of or in connection with these Terms or your use of the Applications, whether based in contract, tort, strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.
To the extent any of the foregoing exclusions are unenforceable, our aggregate liability to you for all claims arising out of or relating to these Terms or the Applications will not exceed the greater of (a) the amount you paid to Profusions in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100). Nothing in these Terms limits liability for claims that cannot be limited under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless AZ Profusions LLC, its affiliates, officers, directors, employees, contractors, Providers (acting in their non-clinical capacity), and agents from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of (i) your use or misuse of the Applications, (ii) your violation of these Terms or any applicable law, (iii) any content you submit, or (iv) your violation of any third-party right. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us at your expense.
Termination
You may stop using the Applications at any time. We may suspend, restrict, or terminate your account and your access to the Applications, with or without notice, if we believe you have violated these Terms, created a safety or legal risk for us or any Provider, or engaged in fraudulent or abusive conduct.
Upon termination, your right to use the Applications immediately ceases. Sections of these Terms that, by their nature, should survive termination — including payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
Modifications to Services & Terms
We may, at any time and without prior notice, modify, suspend, discontinue, or restrict any part of the Applications, including pricing, features, supported geographies, and available medications. We may also revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and, where required by law or where the changes are material, we will provide additional notice (such as an email or in-portal alert).
Your continued use of the Applications after a revision takes effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Applications.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles, and by applicable US federal law, including HIPAA. The federal and state courts located in Maricopa County, Arizona, will have exclusive jurisdiction over any dispute that is not subject to arbitration under this section, and you consent to personal jurisdiction and venue in those courts.
Informal Resolution First
Before filing a claim, you agree to first contact us at admin@myprofusions.com and attempt to resolve the dispute informally for at least sixty (60) days. Most disputes can be resolved this way.
Binding Arbitration & Class-Action Waiver
If informal resolution does not succeed, you and Profusions agree that any dispute arising out of or relating to these Terms or the Applications will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration held in Maricopa County, Arizona (or remotely, where permitted). You and Profusions waive the right to participate in a class action, class arbitration, or representative action. This arbitration agreement does not apply to (a) small-claims-court actions, (b) injunctive or other equitable relief to protect intellectual property, or (c) any dispute that cannot lawfully be arbitrated.
Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, HIPAA Notice of Privacy Practices, SMS Terms, and any other policies referenced or expressly incorporated, constitute the entire agreement between you and Profusions regarding the Applications and supersede any prior or contemporaneous agreement on the same subject.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Profusions to be effective.
Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, financing, or sale of assets.
Force Majeure
Neither party will be liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, government action, labor disputes, supply-chain disruption, internet or utility outages, cyber-attacks, or war or civil unrest.
